Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and FORTYATSIXTY HEALTH TECH PRIVATE LIMITED, operating as Beet.Health ("Beet.Health", "we", "us", or "our"), governing your access to and use of the Beet.Health Client App (the "App") and related services (together, the "Service").

By creating an account or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

Beet.Health is a practitioner platform that connects individuals ("Clients") with nutritionists, dietitians, and lifestyle-medicine practitioners ("Practitioners") for personalised nutrition coaching. The Service includes meal planning tools, progress tracking, in-app messaging, and appointment scheduling between Clients and their assigned Practitioner.

We may add, change, or remove features at any time. We'll make reasonable efforts to notify you of material changes that affect how you use the Service.

• Age: the Service is intended for users aged 18 years and above.
• Accurate information: you agree to provide accurate, current information when creating your account and to keep it up to date.
• Account security: you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• One account per person: accounts are personal to you and may not be shared, sold, or transferred.

Content and recommendations delivered through the App, such as meal plans, nutrition guidance, and progress insights, are provided by your Practitioner or generated to support their guidance. They are intended for general wellness purposes and reflect your Practitioner's own professional judgement, not a medical diagnosis or treatment plan from Beet.Health.

Always consult a qualified physician before making significant changes to your diet, especially if you have an existing medical condition, are pregnant or nursing, or are taking medication. In a medical emergency, contact emergency services immediately. Do not rely on the App.

5.1 If you are a Client

• You agree to provide your Practitioner with accurate health, dietary, and lifestyle information so they can give you appropriate guidance.
• Meal plans and recommendations are guidance, not instructions you're obligated to follow without your own judgement about what's safe for you.

5.2 If you are a Practitioner

• You confirm you hold any qualifications, licences, or certifications required in your jurisdiction to provide nutrition or dietary guidance.
• You are solely responsible for the professional advice, meal plans, and recommendations you provide to Clients through the Service.
• Beet.Health is a tool that supports your practice. It does not supervise, review, or take responsibility for the clinical content of your guidance.

You agree not to:

• Share your account credentials or let anyone else use your account.
• Use the Service for any unlawful purpose, or in a way that harasses, abuses, or harms another user.
• Attempt to access another user's account, data, or Practitioner-Client conversations without authorisation.
• Scrape, reverse-engineer, or extract data from the App using automated tools.
• Upload content that is false, defamatory, or infringes someone else's rights.
• Impersonate a licensed practitioner if you are not one.

We may suspend or terminate accounts that violate this section, as described in Section 12 (Termination).

You retain ownership of the content you submit through the App (meal logs, progress photos, messages). By submitting it, you grant Beet.Health a licence to use it solely to operate and improve the Service for you, for example by displaying your progress history back to you and your Practitioner.

The Beet.Health name, logo, App design, and underlying software are owned by FORTYATSIXTY HEALTH TECH PRIVATE LIMITED and protected by intellectual property law. You may not copy, modify, or redistribute them without our written permission.

The App integrates third-party services, including Firebase, Android Health Connect, Apple In-App Purchase, and Google Play Billing, to deliver parts of the Service. Your use of those integrations is also subject to the relevant provider's own terms. Beet.Health is not responsible for the availability or performance of third-party services outside our control.

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including, to the extent permitted by law, warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the Service will be uninterrupted, error-free, or that any specific health outcome will result from using it.

To the maximum extent permitted by applicable law, Beet.Health and its officers, employees, and partners will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including health outcomes resulting from guidance received from a Practitioner through the App. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold Beet.Health harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the Service, or content you submit through the App.

You may stop using the Service at any time.

We may suspend or terminate your access to the Service if you violate these Terms, misuse the platform, or if required by law. Where reasonably possible, we'll notify you before doing so.

These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or the Service will first be addressed through good-faith negotiation; if unresolved, it will be subject to the exclusive jurisdiction of the courts located in Telangana, India.

We may update these Terms from time to time. For material changes, we will:

• Notify you via an in-app banner or push notification at least 7 days before changes take effect.
• Update the “Last updated” date at the top of this page.
• Publish the updated Terms at beet.health/terms.

Continued use of the Service after changes take effect means you accept the updated Terms. If you disagree, please stop using the Service.
